Terms of Service

1. Service Description

The Service is a B2B email campaign management platform that enables authorized users to connect Gmail accounts, create personalized email campaigns, and send messages on a scheduled basis. The Service is intended for business use by authorized personnel only and is not a consumer-facing product.

2. Eligibility and Access

• Access to the Service is restricted to users who have been provisioned an account by an administrator.
• You must use a valid organizational email address to sign in via Google OAuth.
• You are responsible for maintaining the security of your account and for all activities that occur under your account.

3. Connected Gmail Accounts

• The Service allows you to connect Gmail accounts as sender accounts for email campaigns. You represent that you have authorization to connect and send email from each Gmail account you add to the Service.
• We access Gmail solely through the gmail.send scope to send messages on your behalf. We do not read, modify, or delete existing emails in connected accounts.
• You may disconnect any Gmail account at any time through the Sender Accounts page. You may also revoke access through your Google Account permissions.

4. Acceptable Use

When using the Service, you agree to:

• Comply with all applicable laws, including the CAN-SPAM Act, GDPR, CASL, and other anti-spam and data protection regulations.
• Send emails only to recipients who have a legitimate business relationship with your organization or who have otherwise consented to receive communications.
• Include accurate sender information and a functioning unsubscribe mechanism in all campaign emails.
• Not use the Service to send unsolicited bulk email (spam), fraudulent messages, phishing attempts, malware, or any content that is illegal, harmful, or deceptive.
• Not attempt to circumvent sending limits, rate controls, or sender health safeguards built into the Service.
• Respect Gmail's sending limits and usage policies.

5. Data and Privacy

Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood the Privacy Policy, including how we handle data obtained through Google APIs in compliance with the Google API Services User Data Policy.

6. Intellectual Property

The Service, including its design, code, and documentation, is the property of ScaleItForMe. You retain ownership of all content you create or upload through the Service, including email templates, recipient lists, and campaign configurations.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance, deploy updates, or temporarily suspend the Service as needed. We will make reasonable efforts to provide advance notice of planned downtime.

8. Termination

• We may suspend or terminate your access to the Service at any time for violation of these Terms, including misuse of connected Gmail accounts or sending of prohibited content.
• Upon termination, your connected Gmail accounts will be disconnected and stored OAuth tokens will be deleted.
• You may request deletion of your account and associated data by contacting us at legal@scaleitforme.com.

9. Limitation of Liability

To the maximum extent permitted by law, ScaleItForMe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to email delivery failures, account suspensions by Google, or data loss. Our total liability shall not exceed the amounts paid by you to us in the twelve months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that emails sent through the Service will be delivered to recipients' inboxes or that the Service will meet your specific requirements.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
